PM’s full-scale legal attack on JIT in Supreme Court of Pakistan (THE NEWS 18 JUL 2017)

ISLAMABAD: Prime Minister Nawaz Sharif launched a full-scale legal attack on the Joint Investigation Team (JIT) stressing that its report presented to the Supreme Court was an eyewash and was undertaken with a predisposed mind to malign and implicate him in some wrongdoing.
Except the representative of the Military Intelligence in the JIT, the premier, in his rejection of the team, assailed the credibility and standing of its other five members, painting them as biased, partisan and affiliated with his political rivals.

It is submitted with respect that one of the more aggressive members of the JIT (Brig Nauman Saeed), whose depiction was given in one of the earlier applications (CMA No.3688 of 2017 submitted before the bench), was subsequently identified to be the ISI nominee,identified to be the ISI nominee, Nawaz Sharif’s response said.
It said that it has further been revealed that the ISI nominee was not its officer at the time of his nomination, rather he was a ‘source employee’ under a contract which is not recognized as legal, and reportedly neither his association with the spy agency nor his pay is reflected in any official record.
Meanwhile, the two latest prayers made by Nawaz Sharif – absolute rejection of the JIT findings and release of Volume-X – were not taken up on the first day of the attention-grabbing proceedings. The petitioners’ lawyers completed their preliminary arguments on the JIT report and the premier’s counsel Khawaja Haris opened his submissions. The pace thus observed gave the impression as if the case may not take too long to conclude.
The prime minister also pointed out the charges against JIT members – Bilal Rasool and Amer Aziz – for being prejudiced against him. The Sharif family has already highlighted these claims against them.
Inside the courtroom, Justice Ejaz Afzal asked: Without knowing what the sources are, can we say that the documents are accurate? He said that it would have to be verified whether the documents procured from abroad were transferred to Pakistan through legal means. Pakistan Tehreek-e-Insaf (PTI) attorney Naeem Bokhari said it was for the JIT to reply this question. He sought summoning of the prime minister and his family members for cross-examination.
However, not only Bokhari, but the Jamaat-e-Islami lawyer and Sheikh Rashid completely owned the JIT report because it incorporated all of their accusations and allegations against the Sharif family. They were tremendously facilitated as they were not required to give any new argument but spoke on what the JIT has held. They repeated what has been written in its findings. However, the bench made it clear that it was not binding on the judges to accept the JIT report and pointed out that some of the documents that have been relied upon in the report were not authenticated and certified.
In his rejection application, Nawaz Sharif said the hiring of UK based litigation firm Quist London, a company admittedly belonging to one Akhtar Raja, a cousin of JIT head Wajid Zia, whose owner is also reportedly a worker of the Pakistan Tehreek-e-Insaf (PTI) London, is illegal and unsupported by law and does not qualify as permissible in terms of Mutual Legal Assistance (MLA) under Section 21(g) of the National Accountability Ordinance (NAO), 1999.
Justice Ejaz Afzal remarked that if need be the Volume-X of the JIT report, incorporating MLA requests, can be made public so that everything was transparent. Nawaz Sharif demanded release of the volume.
Another ground of rejection of the JIT report, according to the premier, was that the respondents were never shown any documents during the recording of their statements and, thus, none of them was confronted with or called upon to explain their position vis-à-vis any of these papers. It is thus evident that the entire investigation was a farce.
The JIT members, the prime minister wrote, exceeded their jurisdiction and authority conferred by law in obtaining documents from abroad, inter alia, by hiring private firms, and thereby wasted public time and money in rendering an incomplete, inconclusive and legally untenable and inherently defective report.
The JIT overstepped its jurisdiction in giving a detailed finding on each of the 13 questions (+2 non-existent queries claimed by the JIT to have been) referred to it by the April 20 Order of the Court, in that as an investigation body, and as per the terms of the court order, it was appointed only to collect evidence on each of the questions referred, and  not to pronounce a judgment or prepare findings on the basis of the evidence so collected, the latter being the prerogative of the court as it constituted a judicial function.
Nawaz Sharif said that the MLA requests were to be addressed to a foreign state and not to private firms or entities, and such evidence and documents alone are inadmissible in evidence under Section 21(g) of the NAO (this provision having been specifically quoted by the JIT) as are transferred to Pakistan by a foreign government, and not that which are procured from or delivered by private firms.
He believed that not only the bulk of the documents relied upon by the JIT especially from foreign jurisdictions, have been illegally procured, none of them bears the attestation in accordance with the law nor are any of them is original, and most of them do not bear the signatures of any executant or scribe, while no statement of any witness who scribed, executed or witnessed any of these papers has been recorded by the JIT.
The premier said that in any case the JIT had been given 60 days for completing their investigation, and they having availed an extra 6 days on this account, and having represented before the court on July 10 that they are submitting a complete report, they cannot now be allowed to place any further document on the record.

The JIT report is reflective of the ingrained bias and prejudice of its members towards and against the prime minister, he said.

Not bound by JIT: SC (THE NEWS Jul 18 2017)

ISLAMABAD: Justice Ijazul Ahsan on Monday said the Supreme Court bench was not bound to follow or implement the JIT report.
“The entire country knows the JIT’s findings…we are not bound by them,” he remarked during the arguments submitted by the counsel for the JI.“The counsel has to tell us as to why we should implement the findings,” he said, adding, “Tell us to what extent we can implement the suggestions of the JIT.”

The remarks came as the counsels for the PTI and JI as well as Awami Muslim League chief Sheikh Rasheed presented their arguments before the three-member bench to disqualify Prime Minister Nawaz Sharif on the basis of JIT’s findings in the Panama Papers case. They concluded their arguments on Monday but asked the court that they reserved the right of rebuttal.
The bench said the statements would be considered under CrPC (Criminal Procedure Code), adding that the Volume-X of the JIT report could also be opened, if required.Naeem Bukhari, the counsel for PTI, pointed out parts of the report and said in view of the UAE Ministry of Law’s letters, the JIT found Tariq Shafi’s affidavits fake, which were submitted before the Supreme Court.
He said the JIT had submitted the report and it was up to the court to draw a conclusion whether the exercise made by the JIT was according to the parameters set by the bench. He said the Sharif family’s assets exceeded the income and the JIT found that Maryam Nawaz was the beneficial owner of the London flats.
Bukhari requested the apex court to summon the prime minister for cross examination, disqualify him from parliament and send cases against him and his family to an accountability court.
Bukhari termed the Qatari prince’s letter a concocted tale, adding that the London properties had been in possession of the Sharif family since day one.He said one of the respondents gave documents to the JIT. But when Justice Ijaz inquired whether they were certified, the PTI counsel’s reply was in the negative.
Bukhari argued that the JIT wrote four letters to Qatari Prince Sheikh Hamad bin Jassim bin Jaber Al-Thani to record his statement but the royal family member’s response was that he was not willing to accept the jurisdiction of Pakistani law. The JIT stated in the report that it was not necessary to record his statement, he added.
During the proceedings, the counsel claimed that the Qatari prince’s letter proved to be bogus.When Justice Ejaz Afzal Khan asked him whether the letter was bogus or the story around that, he replied both were bogus.
Bukhari said the JIT sought legal assistance from the UAE and found that the transaction of 12 million dirhams never took place.
He also contended that it was claimed that the Gulf SteelMills were sold for 33 million dirhams, which wasn’t the case and the Sharif family had been unable to clear its position on the issue.
Taufeeq Asif, representing JI chief Siraj-ul-Haq, said prima facie the case for disqualifying the prime minister had been proved.
He read out the portions of the report wherein the JIT discussed the inconsistencies in the statements of witnesses. He said in his address to the Parliament, the prime minister told a lie.
Sheikh Rashid, in his arguments, said the respondents had not so far contradicted the objections raised by the JIT report.
He said the Sharif family’s wealth was accumulated during the period when they were in power. “There is a face behind every case and the face is of the prime minister in this case,” he remarked.
He lauded the JIT for its efforts and said the six super heroes had completed their work in 60 days, which could not be achieved in a year in ordinary circumstances. He claimed that Saif-ur-Rehman and Sheikh Saeed were the mastermind of the Sharifs’ corruption.

Later, Khawaja Haris, the counsel for prime minister, commenced his arguments and told the court that he had filed an application on behalf of his client, seeking copy of Volume-X of the JIT report besides filing objections to the findings. The court adjourned the hearing until today (Tuesday) wherein Khawaja Haris will continue his arguments.

JIT recommends filing of reference against PM Nawaz, daughter and sons with NAB

ISLAMABAD: The Joint Investigation Team (JIT) , constituted by the Supreme Court, submitted its report on Monday recommending that a reference be filed with the National Accountability Bureau (NAB) against Prime Minister Nawaz Sharif and his family after disparities were found between their known source of income and the family’s actual wealth.

The JIT recommends filing of the reference under Section 9 of NAB Ordinance 1999 against Prime Minister Nawaz Sharif, daughter Maryam Nawaz and sons Hasan and Hussain Nawaz.
"Significant gap/disparity among the known and declared sources of income and the wealth accumulated by the Respondent No. 1, 6, 7 and 8 have been observed," said the investigation team in its closing remarks.

In the report, Respondent 1 refers to Prime Minister Nawaz Sharif, Respondent 6 refers to Maryam Nawaz, Respondent 7 refers to Hussain Nawaz and Respondent 8 to Hasan Nawaz.

“The financial structure and health of the companies in Pakistan having linkages to the Respondents also do not substantiate the wealth of Respondents,” added the document.

"Moreover, irregular movement of huge amounts in shape of loans and gifts from Kingdom of Saudi Arabia-based company (Hill Metals Establishment), United Kingdom based companies (Flagship Investments Limited and others) and United Arab Emirates based Company (Capital FZE) to Respondent No. 1, Respondent No. 7 and Pakistan based companies of Respondent No. 1 and family have been highlighted."

"The role of off-shore companies is critically important as several offshore companies [companies mentioned by name] have been identified to be linked with their businesses in UK while conducting this investigation. These companies were mainly used for inflow of funds into UK based companies; which not only acquired expensive properties in UK from such funds but also revolve these funds amongst their companies of UK, KSA, UAE and Pakistan."

"In addition to the companies, Respondent No. 1 and 7 have been found to be recipients of these funds movement into Pakistan as gifts/loans whose purpose/reason have not justified by them before the JIT. Needless to say, these UK companies were loss-making entities with heavily engaged in revolving of funds vis-a-vis creating a smoke screen that the expensive properties of UK were due to the business operations of these UK companies," added the closing remarks.

The investigative team refers to Section 9(a)(v) of the National Accountability Ordinance, 1999 in its report, which states - "A holder of public office, or any other person, is said to commit or to have committed the offence of corruption and corrupt practices [....] if he or any of his dependents or benamidars owns and possesses or has acquired right or title to any assets or holds irrevocable power of attorney in respect of any assets or pecuniary resources disproportionate to his known sources of income, which he cannot reasonably account for or maintains a standard of assets beyond that which is commensurate with his sources of income...."
